Created in 1987, the program is administered by the Office of the Attorney General. A five-member board determines appeals and sets policy. Board members are appointed to four-year staggered terms by the governor, with the advice and consent of the senate; one member must be an attorney and one member must be a victim or survivor. The program also pays for forensic examinations in sex-assault cases through a separate procedure.
The program receives a percentage of a mandatory court-cost assessment. The program also receives an annual VOCA grant.
Reporting period: 72 hours
Filing period: 1 year
Exceptions: Good cause; requirements liberally waived for
minors
Each claims specialist is assigned to process applications from a specific area of the state. The staff and director are authorized to make decisions on all applications.
Appeals: The board hears appeals by applicants. Applicants requesting an appeal are mailed notification of where the board will meet to hear the appeal 60 calendar days in advance, and are notified of the board decision within 15 days.
Maximum award: $10,000
Compensable costs (with limits)
Under Act 396 of 1991, the Crime Victim Reparations Board will reimburse a medical facility for costs incurred in performing a medical-legal examination and tests for venereal disease on sexual assault victims.
�treatment sought and rendered within 48 hours (minors excluded);
�reported to law enforcement prior to or during examination;
�treatment not for a pre-existing injury, physical injury or any other condition; and
�victim not covered by a federally financed benefits program, such as Medicaid, Medicare, Champus or VA.

Should the victim be billed? NO! In fact, it is against federal law to bill a victim for expenses incurred during the medical-legal examination.
