A Victims of Violent Crime Compensation fund, administered by the Massachusetts Attorney Generals Office, is available to compensate victims and survivors of violent crimes, and serious motor vehicle crimes. Actual financial losses, such as medical, dental and counseling expenses not covered by insurance, may be claimed. The injuries suffered must relate to the crime committed, but payment of compensation does not depend on a defendant's conviction. The crime must be reported to the police within 4-8 hours, unless there is a valid reason for reporting at a later time. There is no requirement of arrest or prosecution of the offender. Victim Advocates from our office provide crime victims and family members with information and assistance with the claims process for Victims of Violent Crime Compensation.
RESTITUTION: Restitution is defined in Massachusetts laws as money or services which a Judge orders a defendant to pay or provide to a crime victim as part of a defendant's sentencing. A crime victim has the right to request that restitution be a part of the final disposition of a case in court.
Restitution may be ordered for any crime victim who is determined to have suffered a financial loss, property damage or physical injury as a direct result of a defendant's criminal act. A restitution claim can also be made by a city/ town government that suffers a loss or damages caused by a defendant's crime.
Any information regarding your injuries or out-of-pocket losses resulting from the offense should be brought to the Advocates attention as soon as possible. This information will be presented to the Judge by the Assistant District Attorney at the time of sentencing. In appropriate cases, the Judge may order the defendant to reimburse you for your financial loss as a part of the sentence imposed.
SOCIAL SERVICES REFERRALS: Victim/Witness Advocates work with many community agencies that offer additional services that may be needed immediately after a criminal victimization, or for short or long term help in dealing with the emotional, physical and financial Injuries often suffered by crime victims and family members. Information and referrals for counseling, financial assistance, emergency housing, child care and support groups are among the resources available, if needed.
VICTIM IMPACT STATEMENT: In felony cases and motor vehicle homicide cases, a victim or family member is entitled to notice of the time, date and place of sentencing, following a defendants conviction. The victim or a family member has the right to be present at the sentencing and may offer a recommendation on sentencing to the Court. He or she also has the right to make a statement to the Court, orally or in writing, about the physical, financial and psychological impact of the crime on his/her life. A Victim Advocate will explain the procedure and offer you support and assistance throughout the process.
