1. PAYMENT FOR
SERVICES
1.1
Each shell account customer (hereinafter "User") agrees to pay StrayNet
Online (hereinafter "StrayNet Online") in advance for any and all
services.
1.2
For residents of the United States and Canada, User may make payments with
a personal cheque drawn on a United States bank, bank draft, or money order.
Residents of all other nations must pay by a personal cheque drawn on a
United States bank, bank draft or money order. All payments shall be made
in United States dollars.
1.3
All shell accounts are billed monthly or yearly. Account renewal is automatic
unless otherwise specified by User, or User did not pay, or conditions
for the termination of this User Agreement (hereinafter "Agreement") as
outlined in section 6 are met.
1.4
StrayNet Online must inform User of any of any pricing changes to its services
that are relevant to the type of shell account utilized by User at least
ten (10) days prior to applying any payments for automatic account renewal.
This notice may be given in the form of email to the User, at the User's
designated email address with StrayNet Online.
1.5
In accordance with section 1.3 of this Agreement, if a credit card was
used to make the original purchase, StrayNet Online is permitted to apply
the appropriate charge to the same credit card for all automatic account
renewals, unless alternate credit card information is supplied to StrayNet
Online by User.
1.6
StrayNet Online agrees to supply User with a receipt for all payments.
This receipt may be given in the form of email to the User, at the User's
designated email address with StrayNet Online.
2. USER REQUIREMENTS
2.1 User
must be at least 18 years of age. Persons under the age of 18 must have
parental (or legal guardian) consent to be using StrayNet Online services.
2.2 User
must provide accurate billing information including your legal name, address
and home telephone number. User agrees to report changes to billing information
to StrayNet Online within ten (10) days of the change via an email sent
to [email protected]
3. LIABILITY
3.1
User agrees to defend, indemnify and hold harmless StrayNet Online, its
officers, directors, contractors, employees, and affiliates for any loss
or damages awarded by a court of competent jurisdiction resulting from
any claim, action, or demand arising out of or related to the use or misuse
of the User's shell account. This includes but is not limited to any possible
damages resulting from interruptions or delays in any service, deletion
of User's files, termination of any of User's processes on any of StrayNet
Online's servers, errors in performance of duties by StrayNet Online staff,
and third party or unauthorized attacks on StrayNet Online or its assets
and resources.
3.2
User agrees to defend, indemnify and hold harmless StrayNet Online, its
officers, directors, contractors, employees, and affiliates for any legal
actions brought against User by any third party for User's use or misuse
of their StrayNet Online shell account.
4. APPLICABLE
LAW
4.1
This Agreement shall be governed by the laws of the State of Maryland,
and any challenge to the Agreement must be made in an Maryland court.
5. DISCLOSURE
OF USER INFORMATION
5.1 StrayNet
Online agrees to hold User's billing information in the strictest of confidence.
StrayNet Online agrees not to give or sell User's billing information to
any mailing lists.
5.2 User
accepts that StrayNet Online will comply fully with any investigation conducted
by any law enforcement agency. This includes but is not limited to disclosing
to any law enforcement agency full User billing information, activity logs,
and any other information deemed relevant by StrayNet Online officials.

6. TERM OF
AGREEMENT
6.1
The term of this Agreement shall begin once StrayNet Online notifies User
of account activation. Notice of account activation may be delivered in
the form of email to the non-StrayNet Online email address provided by
User on the Account Set-up Form.
6.2
User may end this agreement by giving notice in the form of email to [email protected]
that User wishes to cancel his/her shell account at which time StrayNet
Online may not automatically renew the shell account as outlined in section
1.3 of this Agreement. The shell account de-activation date shall be three
(3) months or one (1) year from the account activation date or last automatic
renewal date, dependant upon the applicable User payment option. Once account
de-activation is complete this Agreement is terminated, except for the
terms and conditions outlined in section 6.5 of this Agreement.
6.3
User may de-activate account immediately by giving notice in the form of
email to [email protected] that User
wishes immediate de-activation, thereby terminating this Agreement, however
no refund is required by StrayNet Online for any unused services.
6.4
StrayNet Online may terminate this Agreement at any time, for any reason
it deems necessary, without notice. Should this course of action be required,
StrayNet Online agrees to promptly refund User full amount for unused services,
unless User violates the terms and conditions of the Acceptable Usage Policy
(Section 7) of this agreement in which case no refund for any service is
required from StrayNet Online.
6.5
User agrees that termination of this Agreement, initiated either by User
or StrayNet Online, does not nullify section 5 (DISCLOSURE OF USER INFORMATION)
of this Agreement. User agrees that StrayNet Online may disclose any information
to law enforcement agencies, as outlined in section 5 at any time.
7. ACCEPTABLE
USAGE POLICY
7.1
User agrees that engaging in any illegal activity that violates any law
passed by any government recognized by the United States of America qualifies
as a violation of the Acceptable Usage Policy (Section 7) of the Agreement.
7.2
User agrees that storing the following types of files in their work space
on any StrayNet Online computer qualifies as a violation of the Acceptable
Usage Policy (Section 7) of the Agreement: pirated software, pornographic
materials, password crackers, computer hacking utilities.
7.3
User agrees that storing any type of file or information which violates
the copyright laws of any country recognized by the United States government
qualifies as a violation of the Acceptable Usage Policy (Section 7) of
the User Agreement.
7.4
User agrees that engaging in "denial of service" attacks, either directly
or indirectly through any process initiated by User, against any other
person, group of people, organization, or corporation connected to or not
connected to the internet using StrayNet Online resources qualifies as
a violation of the Acceptable Usage Policy (Section 7) of the Agreement.
7.5
User agrees that storing or distributing unauthorized bank card, debit
card, or credit card information on StrayNet Online resources qualifies
as a violation of the Acceptable Usage Policy (Section 7) of the Agreement.
This activity is commonly known as "carding" and will be reported to the
United States Federal Bureau of Investigations.
7.6
User agrees that trying to gain unauthorized electronic access to computer
systems or servers (whether they are owned by StrayNet Online or not) qualifies
as a violation of the Acceptable Usage Policy (Section 7) of the Agreement.
This activity is commonly known as "hacking" and will be reported to the
United States Federal Bureau of Investigations.
7.7
User agrees that using StrayNet Online resources to send out bulk unsolicted
electronic mail qualifies as a violation of the Acceptable Usage Policy
(Section 7) of the Agreement.
7.8
User agrees that running IRC "bots" on servers/networks that do not allow
them qualifies as a violation of the Acceptable Usage Policy (Section 7)
of the Agreement.
7.9
User agrees that posting information of any kind on any news server that
will result in any user of the internet being "spammed", harassed, or electronically
attacked qualifies as a violation of the Acceptable Usage Policy (Section
7) of the Agreement
7.10
User agrees that sharing User's shell account with any other person for
any reason qualifies as a violation of the Acceptable Usage Policy (Section
7) of the Agreement.
7.11
User agrees that running the following types of applications, services
or processes on StrayNet Online resources qualifies as a violation of the
Acceptable Usage Policy (Section 7) of the Agreement: xdcc offer bots,
ircd servers, unauthorized MUDs, fservers.
8. CHANGES
TO USER AGREEMENT
8.1
User agrees that StrayNet Online may change the Agreement from time to
time without notifying User.
8.2
User accepts responsibility of keeping themselves informed of any changes
to the Agreement.
9. SEVERABILITY
9.1 If any
provision of the Agreement is held by a court of competent jurisdiction
to be contrary to the law, the remaining provisions of the Agreement will
continue to be in full force and effect.
10. ENTIRETY
10.1
This Agreement contains the entire agreement between StrayNet Online and
User and there are no other promises or conditions in any other agreement
whether written or oral. This Agreement supersedes any prior written or
oral agreements between StrayNet Online and User.
