TERMS OF AGREEMENT

The sole task of Jovan Garcia’s Web Page Creation is to create and publish and maintain Web Pages as indicated on the host page (http://nav.to/jovatec) and the TERMS OF AGREEMENT (TOA) belonging to Jovan Garcia’s Web Page Creation. Other than this, Jovan Garcia is held responsible for nothing else.

I, ________________________________________________________, have agreed to and understand the TOA written by Jovan Garcia. I will continue to respect its authority in decision making for the duration of my service period.  I understand that Jovan Garcia’s sole responsibilities are indicated under ‘A: Jovan Garcia’s Responsibilities’. I understand that it is my responsibility to adhere to the rules and instructions as indicated under ‘B: Customer Responsibilities’. I also understand what my Startup Payment covers as indicated under 'C: Startup Payment Coverage'. I also agree to sign the TOA with Jovan Garcia present and signing as well. I understand that Jovan Garcia cannot be held responsible for mishaps occurring outside his repairing abilities, but that he will make every effort to offer top quality service.

A: Jovan Garcia’s Responsibilities

• Create Web Pages and publish them (up to 3 pages) in FortuneCity.com (short.to/username) domain service, or any other domain indicated in the details section. Customers cannot choose their own domain service, or username, for addresses may have already been purchased by another firm.
• Use all input information that Customer desired (text, images, etc.) of up to 9 MB in size in the web page as indicated in the details section.
• Present the Customer a pre-designed layout of what their page will look like before signing the TOA to assure quality and customer satisfaction.
• Maintain the web pages, but not alter unless [a) customer pays for additional updates or changes, or 2) Jovan Garcia’s requires that pages need to be altered in order to operate]. Jovan Garcia maintains pages for 6 months.
• Terminate customer web pages if Customer requests that the pages be terminated (requires additional cost of $10).
• If for any reason during the 6 month service period, the domain service provider temporarily or permanently disables its service, Jovan Garcia will not be held responsible, but will upon request, transfer all web page content and necessary files onto a storage media for Customer use.
• Jovan Garcia will refund $70 if something hinders him from complying with the TOA. After this, the contract will be terminated with Agreement to Terminate form signed by both the Customer and Jovan Garcia. 

B: Customer Responsibilities

• Cooperate with and sign in all places required on this TOA, the only  TOA written on _Feb_/_25_/_2001. 
• Specify to the web page publisher EXACTLY what he/she would like to have placed on the web page. This includes all text, images, graphics, e-mail links, background and text colors, sounds, and any other media as stated in the host page (http://nav.to/jovatec)
• Make payment BEFORE the signing of this contract using either cash, check or money order. Other forms of payment (Credit Card, IOU, barter, etc.) are not accepted.
• Make payment for additional services if requested (updates, additional pages, etc.) using either cash, check or money order. Other forms of payment (Credit Card, IOU, barter, etc.) are not accepted.
• The customer cannot request a refund for the following reasons: dissatisfaction with page layout, financial hardships or circumstances, after the service period, or because of his/her desire to terminate the web page before the service period ends.
• To speak to Jovan Garcia first before placing concerning dissatisfaction with the service given. 

C: Startup Payment Coverage

$80 Payment covers the following labors:

Web Page Creation and Publishing of up to 3 pages
Page Maintenance for 6 months

$80 Payment does NOT cover the following labors:

Additional web features as indicated on the host page (http://nav.to/jovatec)
Additional web pages beyond the 3 start up pages.
Future customer tech support after 6 months since Web Page publishing

Future TOA may be changed at any time by Jovan Garcia, but will not affect TOA  signed by Jovan Garcia and Customer.
