Section 1: Rights of members
Article 1: Sovereignty
Each Member retains its sovereignty, freedom, and independence, and every
power, jurisdiction, and right, which is not by this Confederation
expressly
delegated to the Splendid Micro- Union of Microstatia, in the General
Assembly assembled.
Section 2: Duties of Members
Article 1: International Duties
Members hereby enter into a firm league of friendship with each other for
their common defense, the security of their liberties, mutual and general
welfare, binding themselves to assist each other, against all force
offered
to, or attacks made upon them, or any of them, on account of religion,
sovereignty, trade, or any other pretense whatever.
Section 3: Executive Power
Article 1: Senate
Clause 1: All members shall comprise the Senate, the main voting body of
the SPUM.
Clause 2: All Member States may sit on the Senate. One delegate is
to be
appointed by the nation to represent them in all things.
Clause 3: All delegates have one vote in all votes. Should a delegate
occupy
more than one position in the SPUM, he/she looses all votes associated
with
the office beyond the one allotted as a delegate.
Clause 4: Observer members may sit on the Senate but may not vote on
any matter.
Article 2: Secretary General
Clause 1: There shall be a Secretary General, who is elected every two
years
by the Senate. He shall be the foreign ambassador for the Splendid
Micro-Union of
Microstatia and Head of the Senate. He must count all votes of
the Senate and Regulor, and announce all decisions.
Clause 2: In the event of a loss of support for a Secretary General,
any
delegate may call for a vote of no Confidence. Should this vote pass
in
favor of the removal of the Secretary General, the Vice Secretary General
shall immediately assume the position of Secretary General and a vote
for a new Secretary General must be called within a week.
Article 3: Vice Secretary General
Clause 1: A vice Secretary General will be appointed by each newly
elected Secretary General.
Clause 2: In the event of the Secretary General being unable to fulfill
his/her duties, the Vice Secretary General shall assume the post.
Section 3: Security
Article 1: The Regulor
Clause 1: The Regulor holds the right to veto any proposition of the
Senate. If vetoed, it must be decided upon by the Secretary General.
Clause 2: The Regulor shall consist of no more than one fifth of the
delegates, chosen by the Senate by majority vote.
Clause 3: Observer members may not sit on the Regulor.
Section 4: War
Article 1: Inter-member war
Members of the Union may not go to war, or commit acts of war against
another Member State. Members who do will face trial by the Senate
and
expulsion from the SPUM.
Article 2: Extra-member war
Clause 1: In the event of a member becoming involved in a military campaign
or war with a non-member, the SPUM delegates are forbidden to aid or
abet
the non-member[s] in any way.
Clause 2: In the event of a member becoming involved in a military
campaign or war with a non-member, the delegate may request that the
SPUM not get involved.
Clause 3: Any member starting a conflict with a non-member must plead
its case to the Senate or face expulsion.
Section 5: Communication
Article 1: Language
Clause 1: The official language of the SPUM shall be English.
Clause 2: Members may freely request the translation of documents put
forth into any other language.
Clause 3: Members shall not be persecuted if they do not wish to work
in English.
Article 2: Transfer of Information
Clause 1: The official method of communication in the SPUM shall be
electronic mail.
Clause 2: A mailing list will be established to facilitate this.
Clause 3: Any member unable to view this list will be provided an
Online archive where it will be their responsibility to view all news
periodically.
Article 3: Freedom of Information
Clause 1: All records and bills passed by the SPUM shall be kept for
reference by the members and non-members.
Clause 2: The members agree to share information with members of the
SPUM
unless said information can be considered secret of state secret.
Section 6: New Members
Article 1: Joining
Clause 1: All nations may apply for membership. An applicant will be
voted upon by the Senate and be allowed in with a majority vote.
Clause 2: The Regulor may not veto an applicant.
Clause 3: An applicant rejected by the Senate may join as an observer
without a vote.
Section 7: Leaving
Article 1: Leaving the Senate
Clause 1: Any nation may leave the SPUM at any time for any reason.
Clause 2: A nation wishing to leave must give two weeks notice to the
Senate. At the end of the two weeks, the nation is no longer a member.
Section 8: Judicial Power
Article 1: Intermicro-Court
Clause 1: The Intermicro-Court shall exist of ten members, or one fifth
of the Delegates, whichever is less. Members shall be appointed by
the
Secretary General.
Clause 2: The Intermicro-Court shall rule on matters pertaining to
legal and
other disputes among members and non-members. A nation must request
the
intervention of the court.
Section 9: Amendments
Article 1: Amendments Formula
Clause 1: All delegates may propose amendments to the constitution.
Clause 2: An amendment will be brought before the Senate for voting.
If
it passes, it will be reviewed by the Regulor. If the Regulor accepts
it,
it shall become law.
Section 10: Violations
Article 1: Punishment
Clause 1: No member may violate this constitution.
Clause 2: Members violating the constitution will be brought before
a
vote of the Senate and punished according to a majority vote.
