Divide and Conquor! This is the way Australian Democracy appears to work. The right of children to live safely in their community gives way to the the right of an adult individual to his/her privacy. It matters not how many children are molested in the intervening time between charges being laid, commital and trial proceedings: bail is granted, leaving the alleged serial child sex offender free to stalk and terrify the victim and the family whose only interim protection is a Restraining Order. This is not sarcasm - it's the truth. It has been my experience and that of countless others. We appear to have taken the concept of a person's right to be believed innocent until proven guilty to an idealistic height that leaves most law-abiding citizens at a considerable disadvantage. Because in our adversarial trial process both the child and its family become the "abusers" and the defendant becomes the innocent victim. |

This appears to be Policy, as written by a staff member of Justice Higgins to someone who lodged a complaint about a particularly bad decision which left an alleged sexual abuser walk free yet again. It is time that these archaic notions were placed in proper perspective because the logical follow-on is to dispense with trials altogether just in case an innocent person is convicted of a crime he/she didn't commit. It is time for children to have a voice against their adult abusers. It is time for professionals at ALL levels, psychologists, psychiatrists, social workers, lawyers, doctors, pediatricians, forensic specialists and offender program managers to come together and recognise that paedophile activity is a major health problem within our society that needs addressing with ACTION and not with pens poised over paper at yet more and more Conferences! |
