Dear Mr Glasl, 


Thank you fur your letter concerning yourexclusion from the list ofcandidates fur the 
recent elections to the European Parliament in Austria.

Unfortunately your letter contains no specific details of the circumstances and it is  
therefore impossible to make any assessment about the validity of your complaint.
Nevertheless I would like to give you some information on the applicable law which you  
may find useful.

The election of the representatives of each Member State to the European Parliament is  
governed by the act concerning the election of the representatives of the Assembly by 
direct universal suffrage, of 29 September 1976, which establishes certain common 
principles, by Directive 93/lO9/EC which lays down detailed arrangements for the 
exercise of the right to vote and stand as a candidate in elections to the European 
Parliament for citizens of the Union residing in a Member State of which they are not 
nationals and, for all the remaining, by the national law of each Member State. The 
purpose of the directive is not to harmonise the electoral law of Member States.

 
It is therefore for national law, in the framework of these common principles, to fix the 
conditions for the presentation of the candidatures at the European Parliment and for the 
national jurisdictions to ensure the respect of the law by administration and citizens.Any 
complaint on these matters should therefore be addressed to the competent authorities of 
the Member State concerned.
