Article 25 of the International Covenant on civil and political rights
Every citizen shall have the right and the opportunity, without
any of the distinctions mentioned in article 2 and without
unreasonable restrictions:
(a) To take part in the conduct of public affairs, directly or
through freely chosen representatives;
(b) To vote and to be
elected at genuine periodic elections which shall be by universal
and equal suffrage and shall be held by secret ballot,
guaranteeing the free expression of the will of the electors;
(c) To have access, on general terms of equality, to public
service in his country.

Article 8
Austria shall have a democratic government based on
elections by secret ballot and shall guarantee to all citizens
free, equal and universal suffrage as well as the right to be
elected to ublic office without discrimination as to race,
sex, language, religion or political opinion.

ARTICLE 3
The High Contracting Parties undertake to hold free elections at
reasonable intervals by secret ballot, under conditions which
will ensure the free expression of the opinion of the people in
the choice of the legislature.

Article 190 (ex Article 138) EU
1. The representatives in the European Parliament of the peoples of the
States brought together in the Community(Gemeinschaft vereinigter
Staaten=Union of united states) shall be elected by direct
universal suffrage.
4. The European Parliament shall draw up a proposal for elections by
direct universal suffrage in accordance with a uniform procedure in all
Member States or in accordance with principles common to all Member
States.
The Council shall, acting unanimously after obtaining the assent of the
European Parliament, which shall act by a majority of its component
members, lay down the appropriate provisions,which it shall recommend
to Member States for adoption in accordance with their respective
constitutional requirements.

Article 23a(1) B-VG
The representatives to the European Parliament which are sent by the
Republic of austria are elected according to the principles of
proportional election because of
the equal, immediate, secret and personal election rights of men and
women which have completed their eighteenth year of life before the
1.January of the election year and have the Austrian citizenship on the
reference day or according to the regulations of the european
Union are not excluded of the election rights or have the citizenship of
another member of the Eruopean Union and are entitled to elections
according to the regulations of the European Union.Detailed provisions
about the election procedure will be established by Federal law

will be established by Federal law
Article 26(4) B-VG
All men and women which have the austrian citizenship on the
reference day and have completed their eighteenth year of life before the
1.January of the election year entitled to be elected.
Paragr. 41 NRWO
All men and women which have the austrian citizenship on the
reference day, completed their eighteenth year of life before the 1.January
of the election year and are not excluded of the election rights are
entitled to be elected.
Paragr. 21(1) NRWO:
All men and women which have the austrian citizenship, completed
their eighteenth year of life before the 1.January of the election year
and are not excluded of the election rights are entitled to elect.

Land parliament(Lower Austria):
Article 95(1) B-VG
The legislation in the lands is carried out by the landparliaments=
Landtag.Their members are elected because of the equal, immediate,
secret and personal proportional election rights of all male and
female statecitizens according to the landelectionorders.
Detailed provisions about the election procedure and other election
obligations will be established by state law. In this state law
there is the reasons to be set up for being excused of nonparticipation
in elections despite of compulsory elections.

Article 19 (ex-Article 8 b) EU
1. Every citizen of the Union residing in a Member State of which he is
not a national shall have the right to vote and to stand as a candidate
at municipal elections in the Member State in which he resides, under
the same conditions as nationals of that State. This right shall be
exercised subject to detailed arrangements adopted by the Council,
acting unanimously on a proposal from the Commission and after
consulting the European Parliament; these arrangements may provide for
derogations where warranted by problems specific to a Member State.
2. Without prejudice to Article 190(4) and to the provisions adopted for
its implementation, every citizen of the Union residing in a Member
State of which he is not a national shall have the right to vote and to
stand as a candidate in elections to the European Parliament in the
Member State in which he resides, under the same conditions as nationals
of that State. This right shall be exercised subject to detailed
arrangements adopted by the Council, acting unanimously on a proposal
from the Commission and after consulting the European Parliament; these
arrangements may provide for derogations where warranted by problems
specific to a Member State.
