Encik Wong Ho Leng asked the Chief Minister and Minister for Resource Planning: Many landowners have complained that their lease term is too short. Many are for 60 years. Upon expiry of these leases, the landowners are required to pay a hefty sum of premium before they could get extension of the lease term. Some premium even amounting to 50% of the land value as valued by the Land and Survey Department. There are also terms and conditions imposed on the extended lease which had otherwise been absent from the original land titles.

(a) How many leases would expire within the next 3 years, 6 years, 10 years and 20 years; and

(b) What criteria are adopted by the State Government as to how much premium are payable for extension of individual leases and what conditions are to be imposed. Please clarify according to agricultural land, residential land, commercial land and industrial land categories.

Ketua Menteri dan Menteri Perancangan Sumber (Datuk Patinggi Tan Sri (Dr) Haji Abdul Taib bin Mahmud): Tuan Speaker, untuk makluman Ahli Yang Berhormat bagi Bukit Assek bahawa sistem sekarang telah berjalan dan diterima rakyat semenjak zaman Pre Land Code dahulu. Melainkan ada sebab-sebab munasabah kita tidak bercadang untuk menukarkan sistem yang telah diterima dan dipakai begitu lama. Mengikut amalan daripada zaman Rajah Brooke lagi sistem ini tidak membebankan rakyat dan apabila tempoh surat tanah tamat selalunya kerajaan bersetuju meluluskannya. Kalau tanah itu di kawasan luar bandar di mana perubahan dalam bentuk kegunaan tanah tidak mungkin berlaku dalam jangka masa yang pendek, tempoh sambungan yang kita lulus adalah cukup panjang, iaitu sama dengan tempoh asal diluluskan. Tetapi kalau ada kemungkinan perubahan kegunaan tanah selalunya akibat daripada pembangunan di satu-satu tempat, jangka rnasa yang lebih pendek terpaksa kita kenakan.

Ahli Yang Berhormat patut menyedari bahawa soal memberi sambungan kepada tempoh hakmilik tanah selepas tempoh asal tamat adalah mengikut budibicara kerajaan, at the discretion of the government dan tidaklah menjadi hak automatik. Ini adalah sejajar dengan amalan semua negara, termasuk Negara Singapura. Asas bagi meletak bayaran premium ialah nilai pasaran or market price walaupun untuk menggalakkan pembangunan, kerajaan hanya mengena di antara 25% sampai 61 % sahaja ke atas pihak yang meminta sambungan lease mereka bergantung kepada percentage-nya, bergantung kepada kedudukan tanah itu sama ada di luar bandar, di kawasan bandar ataupun di pinggiran bandar dan bergantung kepada kegunaan sama ada commercial, residential ataupun agriculture.
